Whether or not they consider your paddleboard to be a vessel will mostly depend on the police officer as well as how they choose to apply the boating rules of any specific state.

For example, if I require a motorized paddleboard, it will be considered a vessel right now, and if you operate it while inebriated, you can expect a BUI.

This is where I get into some murky territory and talk about non-motorized paddleboards. Many states exempt paddleboards from the definition of anyone operating any vessel when they are operated by manual power.

This is where different law enforcement officials’ interpretations of BUI and how they enforce their state’s statutes will differ. Despite the fact that the laws are unclear and the terminology can only be described as perplexing, there’s a good chance you’ll find up in court before everything is addressed.

The best piece of advice I can give you is to avoid operating your paddleboard while you are under the influence of something that can impede your ability to do so. You’ll always be safer if you “Don’t Drink and PaddleBoard.”

Most of us have never thought about whether or not we can obtain a DUI while paddling. While some enjoy the open water and the freedom that paddling provides, some of us may have indulged in a drink of wine or beer on occasion. I’ll admit that when I started investigating this topic, I wasn’t sure if you could get a DUI while riding a paddleboard.

Technically, you can’t acquire a DUI on a paddleboard; instead, you’ll be charged with BUI (Boating Under the Influence), not DUI (Driving Under the Influence). Operating a paddleboard while your BAL is out is unlawful in the great majority of states. The exception is Wyoming, Colorado, where the rate is 0.1 percent.

Paddleboards are considered vessels, not toys when used on public waterways, and while you’re operating the same waters with your paddleboard as motorized boats, paddlers are subject to the same regulations and restrictions, and you can get a BUI for paddling under the influence.

Alcohol will affect reaction time, judgment, coordination, eyesight, and balance. As a result, it has been a major cause of boating deaths and accidents. As a result, drinking alcohol impairs your ability to safely handle a paddleboard, as you are more likely to lose your balance and capsize.

Depending on the state you’re kayaking in, there are some exclusions and unique rules to consider. Where can I find out more about BUI?

When it comes to BUI, alcohol consumption is simply one component of the puzzle. The use of anything that could hinder a paddleboard operator from safely and effectively navigating their board is illegal in most states.

Legal words may differ from state to state, but the meaning of these bylaws stays the same. They consider you to be under the influence of a chemical if you take it and it prevents you from safely and successfully operating a paddleboard.

The officer who stops you may charge you with a BUI if he judges your ability to control your paddleboard has been harmed.

To get some perspective on the situation, I asked a friend who works in law enforcement if he’d ever been charged with BUI. If the substance you’re taking impairs your ability to control your paddleboard in any shape or form, he may suspect you of being under the influence.
